Amendments to Uttarakhand River Rafting Kayaking Rule 5

Uttarakhand amended two sub rules of the Uttarakhand River Rafting / Kayaking Rule 5 (2014) and the Annexure A. The Part – I of the annexure consists of an application form for the commercial kayaking and rafting permit and an undertaking.

Changes in Part – I of the Annexure A

The Part-I of the Annexure has been shortened. The amended annexure has just seven (7) items unlike sixteen (16) items in the 2014 version.

Three of the old sixteen items have been moved to the Undertaking section: item numbers 5, 6, and 9. These three items have become a formal promise but are not the rules anymore. It means that compliance with these conditions is an obligation of the operators.

Since the tariff has been fixed in the amended Rules 2015, there is no need for the old item number 11.

However, the item number 14 that seeks kayaking and rafting business statistics has been deleted from the new annexure. It is not good. Because the business statistics is required for various tasks, including future planning, policy making, matching revenue earned and tax paid.

Moving item number 6 to the Undertaking section also indicates softening of the stand on the participation of the local community. This may affect community based adventure tourism development. It might lead to exodus of local community and thereby overcrowding urban areas.

Relaxations introduced by shifting item 9 of the Annexure to Rule 5 to the Undertaking section could lead to lowering safety standards.

The Undertaking section of the Part-I has been lengthened by three items. So now it has nine (9) items.
