All miscellaneous adventure activity operators wishing to work in Himachal Pradesh have to fill an indemnity bond included in the Form 4 appended to the Himachal Pradesh Miscellaneous Adventure Activities (Draft) Rules (HPMAAR), 2016. The bond is addressed to the prescribed authority of the selected area of operations.
What does indemnity mean?
The indemnity implies that the Government of Himachal Pradesh and its Tourism & Civil Aviation Department shall not be liable to compensate the stakeholders (clients, guides, and / or operators) in case of accidents, emergencies, etc.
Further, the indemnity implies that neither the government nor the department shall bear (1) rescue cost and (2) medical expenses in case of untoward incidents, including minor injuries, major injuries, and death, during the operations.
The operator shall bear all the costs in case of untoward incidents, including accidents, deaths, emergencies, etc. taking place during the operation.
Government of Himachal Pradesh and its Tourism & Civil Aviation Department shall not be liable for any legal action related to the operations.
