Porter Fitness Certificate: Cancellation, Validity

The ninth section of the Himachal Pradesh Climbing / Trekking Porters (Regulation of Employment) Act, 1977 lists a number of provisions for porter fitness certificate:


Validity of Porter Fitness Certificate
Sections 9-1 and 9-1-a
The certificate of fitness issued or renewed as per the requirements of the Section 4-b shall be valid for 12 months from the date of issuance 
Section 9-1-b
The certificate contains conditions specific to the employment and nature of work. 
Cancelation of Certificate of Fitness
Section 9-2
The certifying medical practitioner shall cancel the certificate renewed or granted by him/her if s/he opines that the porter is currently unfit for the work specified in the certificate.
Powers of Certifying Medical Practitioner

Section 9-3
A certifying medical practitioner may

  • Refuse to grant a certificate of fitness
  • Refuse to renew a certificate of fitness
  • Cancel a certificate of fitness                                
Section 9-3
However, the practitioner shall specify the reason for doing the same if the porter asks.                               
Work for Porter
Section 9-4
If the certificate of fitness is issued or renewed as per the requirements of the Section 5 subject to the conditions mentioned in the Section 9-1-b, the porter shall not be permitted to work except when s/he satisfies those conditions.
