Porter Wage Provisions

The Himachal Pradesh Climbing / Trekking Porters (Regulation of Employment) Act, 1977 elaborates on porter wage rates and medical facilities in sections 12, 13, and 14.

Section 12: Porter Wages

The State Government of Himachal Pradesh may notify the following about the porter wages in the gazette: (Section 12-1)
Wage rates for working porters (Section 12-1-a)

Differential wage rates depending on (Section 12-1-a)
• locations
• working conditions

Revise the wages or wage rates regularly / as and when required. (Section 12-1-b)

The wage rates for working porters may be based on (Section 12-2)
• piece of work or
• time required to complete the work

Minimum Porter Wages

All employers shall pay porters, including working porters, at least the wage rates fixed under the Sub-section 1. (Section 12-3)

Favorable Agreements

All porters and employers can enter into the agreements that are more favorable for the porter than the provisions of the Act. (Section 12-4)

Form of Payment

The employers shall pay wages in valid currency notes and / or coins. (Section 12-5)

Section 13: Medical Facilities for Porters

The competent authority prescribes halting stations and operating centers for easily accessible medical facilities for the porters. (Section 13-1)
The employer shall provide and maintain the medical facilities in the recommended centers and stations. (Section 13-1)
The facilities shall be easily available within working hours. (Section 13-2)
The climbing expeditions shall carry a well-equipped first-aid box. (Section 13-2)

Section 14: No Fee for Conveniences, Equipment…

The employer shall not charge for appliances, conveniences, equipment, and medical facilities provided to the porters.
